TERMS OF SERVICE

Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Alpha Labs.

If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.

Eligibility & Age Requirements

Minimum age: You must be at least 13 years of age to use the Service.

Users aged 13–17: Under India's Digital Personal Data Protection Act, 2023 (DPDP Act), and in compliance with applicable child protection laws, users under the age of 18 must have obtained verifiable parental or guardian consent before using the Service and before providing any personal data. By using the Service if you are under 18, you represent that your parent or guardian has reviewed and consented to these Terms and our Privacy Policy on your behalf.

Parental responsibilities: Parents and guardians of minors (under 18) who use the Service are responsible for supervising their child's use of the Service and for any content submitted or activity conducted under their child's account.

Enforcement of Terms against minors: Certain provisions of these Terms — including the limitation of liability, indemnification, and arbitration clauses — may not be enforceable against users under 18 without verifiable parental consent, as required by applicable law.

Your Account

To use Flick, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials and not sharing them with others
• All activity that occurs under your account, whether authorised by you or not
• Providing accurate, current, and truthful information during registration and keeping it updated
• Notifying us immediately at support@joinflick.in of any suspected unauthorised access to your account

You may only create one account per person. Creating multiple accounts to gain an unfair advantage in contests, duels, or leaderboards — or to circumvent a ban — is prohibited and may result in permanent suspension of all associated accounts.

We reserve the right to reclaim usernames that are inactive, impersonate real people, or violate these Terms.

Photo Contests

Flick hosts photo contests where users submit photographs to compete for community votes. By participating in any contest, you agree that:

• You are the original creator of, or hold full legal rights to submit, all photos you upload
• You grant Flick a non-exclusive, worldwide, royalty-free licence to display your submitted photos within the app, on our website, and for promotional purposes directly related to Flick
• Contest results are determined solely by community votes and are final and binding
• You will not use bots, scripts, automated tools, coordinated voting groups, or any other means to artificially manipulate vote counts or contest outcomes
• Contest prizes, if any, are as described in the specific contest details at the time of the contest
• Submissions may be deleted within a time window specified in the app; after that window closes, submissions become part of the permanent contest record

Duels

Flick offers a 1v1 "Duel" feature where two users compete with photos on the same theme, judged by community votes. By participating in duels:

• You agree to the same photo ownership and content requirements as for standard photo contests
• Duel results are determined by community votes and are final
• Quick Match duels may pair you with any available user; by initiating Quick Match, you accept this
• Duel XP rewards are awarded automatically upon conclusion and cannot be reversed or disputed
• You may invite a specific user to a Duo entry; that user may accept or decline at their discretion

Messaging

Flick includes a private messaging feature between users. By using this feature, you agree to:

• Communicate respectfully and not send spam, harassment, threats, hate speech, or unsolicited promotional content
• Acknowledge that messages are stored on our servers and may be reviewed by our moderation team if reported for abuse
• Accept that we may access message content only in response to reports of violations or when required by law

You may block any user at any time to prevent them from contacting you. We reserve the right to remove messages and suspend accounts that misuse the messaging feature.

Content Guidelines

You must not submit, upload, or share any content that:

• Is sexually explicit, pornographic, or depicts nudity of any kind
• Depicts or glorifies violence, self-harm, suicide, or harm to people or animals
• Harasses, bullies, threatens, or targets any individual or group
• Infringes any third party's copyright, trademark, trade secret, or other intellectual property rights
• Contains personal information of others without their explicit written consent
• Promotes hate speech or discrimination based on race, religion, gender, sexual orientation, nationality, disability, or any other characteristic
• Violates any applicable law or regulation in India or internationally
• Is misleading, fraudulent, or deceptive
• Contains malware, viruses, or any other malicious code
• Is generated entirely by artificial intelligence (AI-generated images are not permitted in photography contests)

Reporting Violations

If you encounter content or behaviour that violates these Terms or our Community Guidelines, you can report it directly within the app by tapping the three-dot menu (⋯) on any photo, profile, or message and selecting "Report". You may also contact us at support@joinflick.in for urgent reports.

We review all reports and aim to respond within 48 hours. False or malicious reports made in bad faith to disadvantage other users may result in enforcement action against the reporting account.

User-Generated Content

Flick is a platform that hosts user-generated content. We do not endorse, verify, or take responsibility for content submitted by users. You acknowledge that:

• We are not liable for any user-generated content posted on the platform
• We do not pre-screen or moderate content before it is published, but reserve the right to remove content that violates these Terms after it is reported or detected
• Other users' content may be offensive or objectionable — you access such content at your own risk
• We are not responsible for any loss or damage resulting from your reliance on user-generated content

XP, Levels, Badges & Stars

Flick's XP system, levels, leaderboards, badges, Star Votes, streaks, season rankings, and all other virtual engagement features are provided for entertainment and engagement purposes only. They have no monetary value and cannot be exchanged for real money, goods, or services outside the app.

We reserve the right to modify, recalculate, reset, or discontinue any virtual feature at any time without notice or liability. Virtual items are not property and confer no ownership rights.

Referral Programme

Flick offers an optional referral programme where you can invite friends using a unique referral code. Referral rewards are virtual XP with no monetary value. We reserve the right to modify, suspend, or discontinue the referral programme at any time without notice.

Abuse of the referral system — including creating fake accounts, using automated sign-ups, or any other fraudulent activity — will result in account termination and forfeiture of all rewards.

Prizes & Rewards

Contest prizes vary and are described in the specific contest details before you enter. Prizes may include exclusive badges, gift vouchers, merchandise, or other non-monetary rewards. Flick does not award cash prizes.

Star Votes use in-app stars earned through contest wins and other activities. Stars have no monetary value, cannot be purchased with real money, cannot be transferred between users, and cannot be redeemed for cash or any real-world monetary equivalent.

Prize redemption is subject to: (a) verification of your identity if requested; (b) compliance with these Terms; and (c) the specific terms of the prize as described in the contest details. We reserve the right to withhold prizes from accounts found to have violated these Terms.

Advertising

The Service displays advertisements served by Google AdMob. By using the Service, you consent to the display of contextual and personalised advertisements. You may opt out of personalised advertising through your device settings as described in our Privacy Policy.

We do not share your personal profile information with advertisers. Advertisements are clearly identified as such. We do not endorse any products or services advertised within the Service.

Account Moderation & Bans

We may suspend or permanently ban your account for violations of these Terms, with or without prior notice, depending on the severity of the violation. When your account is actioned:

• You will be notified through the app and via push notification where possible
• You may submit a ban appeal by emailing support@joinflick.in with your username and the reason for your appeal
• We will review appeals within 7 business days and our decision will be final
• Serious violations — including illegal content, severe harassment, or vote manipulation — may result in immediate permanent bans without the right of appeal
• We reserve the right to report illegal content to appropriate authorities

You may delete your own account at any time from Settings → Account → Delete Account.

Prohibited Conduct

In addition to the content guidelines above, you agree not to:

• Attempt to reverse engineer, decompile, disassemble, or hack the app or its backend infrastructure
• Attempt to gain unauthorised access to other users' accounts or our systems
• Use the Service to distribute spam, chain letters, or bulk unsolicited messages
• Impersonate any person, entity, or Flick staff member
• Interfere with or disrupt the integrity, performance, or availability of the Service
• Scrape or collect data from other users without their explicit consent
• Use the Service for any commercial purpose without our prior written consent
• Use the Service in violation of any applicable law or regulation
• Upload photos that watermark or advertise competing photography platforms

Intellectual Property

The Flick app, its design, interface, logo, "Flick" name, branding, and all original content, software, and technology created by Alpha Labs are our exclusive intellectual property protected under applicable Indian and international copyright and trademark laws. You may not copy, reproduce, modify, adapt, translate, distribute, or create derivative works from any part of Flick without our prior written consent.

You retain full ownership of photos you create and submit. By submitting photos, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, distribute, and promote your photos within the Flick platform and for marketing purposes directly related to Flick. This licence ends when you delete your account, subject to the data retention provisions in our Privacy Policy.

Google Play Store

Flick is distributed through Google Play. You acknowledge and agree that:

• These Terms are between you and Alpha Labs, not between you and Google LLC
• Google is not responsible for the Service, its content, maintenance, support, or any claims relating to it
• Google is not obligated to provide any maintenance or support services for the Service
• Your use of the Service is subject to the Google Play Terms of Service in addition to these Terms
• Google and its subsidiaries are intended third-party beneficiaries of these Terms with respect to Google Play-related provisions

Third-Party Services

The Service integrates third-party services including Firebase (Google), Google AdMob, and Google Sign-In. Your use of these services is also subject to their respective terms and privacy policies. We are not responsible for the data practices, content, or conduct of any third party. Links to third-party websites or services do not constitute endorsement by us.

Disclaimers

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses or other harmful components
• Results obtained from using the Service will be accurate or reliable
• Defects in the Service will be corrected
• User-generated content is accurate, complete, or trustworthy

We are not responsible for any loss of data, submissions, XP, badges, streaks, or other virtual content due to technical failures, outages, or account termination.

Limitation of Liability

To the maximum extent permitted by applicable law, Alpha Labs, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed INR 1,000 (one thousand Indian rupees).

Indemnification

You agree to indemnify, defend, and hold harmless Alpha Labs and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) any content you submit, post, or transmit through the Service; (c) your violation of these Terms; (d) your violation of any third party's rights, including intellectual property rights; or (e) any claim that your content caused damage to a third party.

Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government action, power failures, internet or telecommunications failures, cyberattacks, or third-party service failures (including Firebase or Google infrastructure outages).

Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, both parties agree to first attempt to resolve the dispute informally by contacting us at support@joinflick.in. We will attempt to resolve the dispute within 30 days of receiving written notice.

If informal resolution fails, any dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in English, the seat of arbitration shall be India, and the arbitral award shall be final and binding on both parties. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

Governing Law

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDP Act), and the rules and regulations made thereunder. Subject to the dispute resolution clause above, any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts of India.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Alpha Labs with respect to your use of the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of Alpha Labs.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through an in-app notification, push notification, or by updating the "Last updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
