TERMS OF SERVICE

Welcome to Flick, a photo contest application operated by Alpha Labs ("we", "us", or "our"). By downloading, installing, accessing, or using the Flick app or website at joinflick.in ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the Service.

1. Acceptance of Terms

By accessing or using Flick, you confirm that you are at least 13 years of age and have the legal capacity to enter into a binding agreement. Users between the ages of 13 and 18 must have obtained parental or guardian consent before using the Service, particularly before providing any personal information such as birthday, mobile number, or location. If you do not agree to these Terms, you must not use the Service.

2. Your Account

To use Flick, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account, whether authorised by you or not
• Providing accurate, current, and truthful information during registration and keeping it updated
• Notifying us immediately at support@joinflick.in of any unauthorised use of your account

You may only create one account per person. Creating multiple accounts to gain an unfair advantage in contests, duels, or leaderboards is prohibited and may result in permanent suspension of all associated accounts.

3. Photo Contests

Flick hosts photo contests where users submit photographs to compete for community votes. By participating:

• You confirm you are the original creator of, or have full legal rights to submit, all photos you upload
• You grant Flick a non-exclusive, worldwide, royalty-free licence to display your submitted photos within the app, on our website, and for promotional purposes directly related to Flick
• You understand contest results are determined solely by community votes and are final and binding
• You agree not to use bots, scripts, automated tools, coordinated voting rings, or any other artificial means to manipulate vote counts or contest outcomes
• You understand that contest prizes, badges, or rewards, if any, are described in the specific contest details at the time of the contest
• You may submit up to the maximum number of photos permitted per contest, as specified in the contest details
• Submitted photos may be deleted within a limited time window specified in the app; after that window closes, submissions become part of the permanent contest record

4. Duels

Flick offers a 1v1 "Duel" feature where two users compete with photos on the same theme, judged by community votes. By participating in duels:

• You agree to the same photo ownership and content guidelines as photo contests
• You understand duel results are determined by community votes and are final
• Quick Match duels may match you with any available user; by initiating Quick Match you accept this
• Duel XP rewards are awarded automatically upon conclusion and cannot be reversed or disputed
• You may invite a specific user to a duo entry; that user may accept or decline

5. Messaging

Flick includes a private messaging feature between users. By using messaging:

• You agree to communicate respectfully and not send spam, harassment, threats, hate speech, or unsolicited promotional content
• You understand that messages are stored on our servers and may be reviewed by our moderation team if reported for abuse
• You may block any user at any time to prevent them from contacting you or viewing your content
• We reserve the right to remove messages and suspend or terminate accounts that misuse the messaging feature

6. Content Guidelines

You must not submit, upload, or share any content that:

• Is sexually explicit, pornographic, or depicts nudity of any kind
• Depicts or glorifies violence, self-harm, suicide, or harm to others or animals
• Harasses, bullies, threatens, or targets any individual or group
• Infringes any third party's copyright, trademark, trade secret, or other intellectual property rights
• Contains personal information of others without their explicit written consent
• Promotes hate speech, discrimination, or extremism based on race, religion, gender, sexual orientation, nationality, disability, or any other characteristic
• Violates any applicable law or regulation in India or internationally
• Is misleading, fraudulent, or deceptive
• Contains malware, viruses, or any other malicious code

We reserve the right to remove any content that violates these guidelines without prior notice and to suspend or permanently terminate accounts of users who repeatedly or seriously violate them.

7. Reporting Violations

If you encounter content or behaviour that violates these Terms, you can report it directly within the app by tapping the three-dot menu on any photo, profile, or message and selecting "Report". You may also contact us at support@joinflick.in. We review all reports and aim to respond within 48 hours. False or malicious reports may result in action against the reporting account.

8. User-Generated Content

Flick is a platform for user-generated content. We do not endorse, verify, or take responsibility for any content submitted by users. You acknowledge that:

• We are not liable for any user-generated content posted on the platform
• We do not pre-screen or moderate content before it is published, but we reserve the right to remove content that violates these Terms after it has been reported or detected
• Other users' content may be offensive, inaccurate, or objectionable — you access such content at your own risk
• We are not responsible for any loss or damage resulting from your reliance on user-generated content

9. XP, Levels, Badges, and Stars

Flick's XP system, levels, leaderboards, badges, star votes, streaks, season rankings, and all other virtual engagement features are provided for entertainment and engagement purposes only. They have no monetary value and cannot be exchanged for real money, goods, or services outside the app. We reserve the right to modify, recalculate, reset, or discontinue any virtual feature at any time without notice or liability to you.

10. Referral Programme

Flick offers a referral programme where you can invite friends using a unique referral code. When a new user registers using your code, both you and the new user may receive XP rewards as described in the app at the time of referral. Referral rewards are virtual XP with no monetary value. We reserve the right to modify, suspend, or discontinue the referral programme at any time. Abuse of the referral system — including creating fake accounts, using automated sign-ups, or any other fraudulent activity — will result in account termination and forfeiture of all rewards.

11. Boosts and Star Votes

Flick includes optional features such as "Boosts" and star votes that consume in-app stars earned through contest wins and other activities. These are virtual features only. Stars have no monetary value, cannot be purchased with real money, cannot be transferred between users, and cannot be redeemed for cash or any real-world item.

12. Account Moderation, Bans, and Appeals

We may suspend or permanently ban your account for violations of these Terms, with or without prior notice, depending on the severity of the violation. If your account is suspended or banned:

• You will be notified through the app and via push notification where possible
• You may submit a ban appeal by emailing support@joinflick.in with your username and the reason for your appeal
• We will review appeals within a reasonable timeframe, typically 7 business days, and our decision will be final
• Serious violations such as illegal content, severe harassment, or repeated abuse may result in immediate permanent bans without the right of appeal
• We reserve the right to report illegal content to the appropriate authorities

You may delete your own account at any time from Settings → Account → Delete Account.

13. Prohibited Conduct

In addition to content guidelines, you agree not to:

• Attempt to reverse engineer, decompile, disassemble, or hack the app or its backend infrastructure
• Attempt to gain unauthorised access to other users' accounts or our systems
• Use the app to distribute spam, chain letters, or bulk unsolicited messages
• Impersonate any person, entity, or Flick staff member
• Interfere with or disrupt the integrity, performance, or availability of the Service or its servers
• Scrape, crawl, or collect data from other users without their explicit consent
• Use the Service for any commercial purpose without our prior written consent
• Use the Service in violation of any applicable law or regulation

14. Intellectual Property

The Flick app, its design, interface, logo, "Flick" name, branding, and all original content, software, and technology created by Alpha Labs are our exclusive intellectual property protected under applicable Indian and international copyright and trademark laws. You may not copy, reproduce, modify, adapt, translate, distribute, or create derivative works from any part of Flick without our prior written consent.

You retain full ownership of photos you create and submit. By submitting photos to Flick, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, distribute, and promote your photos within the Flick platform and for marketing purposes directly related to Flick (such as app store listings, social media promotion, and press materials). This licence ends when you delete your account, subject to the data retention provisions in our Privacy Policy.

15. Third-Party Services

Flick uses third-party services including Firebase (Google), Google AdMob, and Google Sign-In. Your use of Flick is also governed by these providers' terms of service and privacy policies, which we encourage you to review. We are not responsible for the data practices, content, or conduct of any third party.

16. Disclaimers

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses or other harmful components
• Any results obtained from using the Service will be accurate or reliable
• Any defects in the Service will be corrected
• User-generated content is accurate, complete, or trustworthy

We are not responsible for any loss of data, submissions, XP, badges, streaks, or other virtual content due to technical failures, outages, or account termination.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Alpha Labs, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with:

• Your use of or inability to use the Service
• Any content posted by other users
• Unauthorised access to or alteration of your data
• Any other matter related to the Service

Even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed INR 1,000 (one thousand rupees).

18. Indemnification

You agree to indemnify, defend, and hold harmless Alpha Labs and its officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the Service
• Any content you submit, post, or transmit through the Service
• Your violation of these Terms
• Your violation of any third party's rights, including intellectual property rights
• Any claim that your content caused damage to a third party

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, government action, power failures, internet or telecommunications failures, cyberattacks, or third-party service failures (including Firebase/Google outages). In such events, our obligations shall be suspended for the duration of the force majeure event.

20. Dispute Resolution

In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the Service, both parties agree to first attempt to resolve the dispute informally by contacting us at support@joinflick.in. We will attempt to resolve the dispute within 30 days of receiving written notice.

If informal resolution fails, any dispute shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in English, the seat of arbitration shall be India, and the arbitral award shall be final and binding on both parties.

Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a competent court.

21. Governing Law

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the rules and regulations made thereunder, without regard to conflict of law principles. Subject to the dispute resolution clause above, any legal action or proceeding arising under these Terms shall be brought exclusively in the competent courts of India.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these Terms. The remaining provisions shall continue in full force and effect and shall not be affected by the invalid or unenforceable provision.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alpha Labs with respect to your use of the Service and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, regarding the Service.

24. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorised representative of Alpha Labs. No single or partial exercise of any right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.

25. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through an in-app notification, push notification, or by updating the "Last updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may delete your account.
